On 14 April 2009, the Court received a request for an Advisory Opinion by the Complaints Commission of the Financial Market Authority (Beschwerdekommission der Finanzmarktaufsicht) in proceedings between Inconsult Anstalt v Finanzmarktaufsicht concerning the interpretation of Article 2 Nr. 12 of Directive 2002/92/EC of the European Parliament and of the Council of 9 December 2002 on insurance mediation, in particular, under which circumstances an internet site may be considered as a “durable medium”.
